These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Poland.

 

2. Scope

These Terms & Conditions govern access to all courses, digital products, downloadable files, checklists, templates, community features, and communications provided through Kajabi by qPCR Academy, operated by Katarzyna Ewert-Krzemieniewska.

By purchasing, enrolling in, or accessing any product, you agree to these Terms.

3. No Refund Policy

All digital products are non-refundable.

By purchasing digital content with immediate access, you expressly consent to the immediate performance of the service and acknowledge that you thereby lose your statutory right of withdrawal under applicable EU consumer protection laws, including Directive 2011/83/EU.

No refunds are issued for:

  • completed courses

  • partial use

  • lack of use

  • change of mind

4. Course Access

Unless otherwise stated, access to digital courses is granted for 6 months from the date of purchase.

Access is:

  • personal

  • non-transferable

  • limited to one individual per purchase

Access may be revoked if Terms are violated.

5. Account Rules

By using the platform, you agree not to:

  • share your login details

  • provide account access to third parties

  • download or distribute course materials

  • upload, publish, or host materials outside your account

  • use materials in your own workshops, teaching, or training programs

  • copy, replicate, or adapt materials to create competing courses or products

Violation may result in:

  • immediate course removal

  • revoked access without refund

  • potential legal action for copyright infringement

6. Community Access & Rules

Some purchases include access to the qPCR Academy Community.

By participating, you agree to:

  • follow community guidelines

  • behave respectfully toward other members

  • avoid harmful, offensive, or illegal content

  • avoid spam, promotion, or solicitation

We reserve the right to remove members who violate guidelines or create a disruptive environment without refunds.

7. Intellectual Property

All course materials — including videos, slides, PDFs, graphics, diagrams, workflows, checklists, scripts, quizzes, copy, and community posts — are protected by copyright.

You may not:

  • distribute

  • copy

  • modify

  • publish

  • upload

  • share

  • resell

  • use for teaching or training

  • use to create competing materials or courses

All rights are reserved by qPCR Academy.

qPCR Academy reserves the right to investigate suspected unauthorized use, sharing, reproduction, or distribution of materials and may pursue legal remedies where appropriate.

8. Payments

Payments are processed securely via Stripe or PayPal.

By purchasing, you agree:

  • to pay all fees in full

  • not to initiate chargebacks without valid cause

  • to maintain accurate billing information

Failure to pay may result in revoked access.

9. Testimonials & Optional Photos

If you choose to provide a testimonial, you grant qPCR Academy permission to publish it for marketing purposes.

With explicit consent, the following may be published:

  • name

  • institution

  • city/country

  • job role (optional)

  • testimonial text

  • optional profile photo

Consent may be withdrawn at any time by contacting contact@qpcracademy.com.

Upon withdrawal, qPCR Academy will remove published materials from platforms under our control.

Testimonials reflect individual experiences and opinions and do not represent institutional endorsements.

10. Disclaimers

Courses are provided for educational purposes only.

They do not replace:

  • institutional SOPs

  • manufacturer instructions

  • regulatory guidelines (including IVDR, FDA, or ISO requirements)

  • internal validation or accreditation procedures

qPCR Academy is not responsible for experimental outcomes, decisions, or data interpretation in your laboratory.

11. No Medical or Diagnostic Advice

The content provided by qPCR Academy is intended solely for educational and informational purposes.

Nothing in the courses, materials, community discussions, or communications constitutes:

  • medical advice

  • clinical diagnostic advice

  • regulatory advice

  • legal advice

  • laboratory accreditation guidance

Users are solely responsible for validating experimental workflows, clinical applications, and laboratory procedures in accordance with applicable regulations, accreditation standards, and manufacturer instructions.

12. Liability

To the maximum extent permitted by law, qPCR Academy is not liable for:

  • direct or indirect damages

  • loss of data, revenue, or materials

  • incorrect experimental results

  • misinterpretation of course content

Use of the platform is at your own risk.

13. Access Limitations & Service Interruptions

While we aim to maintain continuous access, we cannot guarantee:

  • uninterrupted service

  • error-free content

  • availability during maintenance, outages, or Kajabi platform issues

qPCR Academy is not liable for temporary service interruptions.

14. Force Majeure

qPCR Academy shall not be liable for delays, interruptions, or failure to perform resulting from causes beyond reasonable control, including but not limited to:

  • internet outages

  • cyberattacks

  • hosting failures

  • governmental actions

  • natural disasters

  • pandemics

  • labor disruptions

  • third-party platform failures

15. Termination

qPCR Academy reserves the right to suspend or terminate access to any course, community feature, or platform service at its sole discretion if a user violates these Terms & Conditions.

Termination may occur without prior notice and without refund in cases involving:

  • unauthorized sharing of materials

  • account abuse

  • copyright infringement

  • disruptive or unlawful behavior

  • suspected fraudulent activity

16. International Users

qPCR Academy operates from Poland.

Users accessing the platform from outside Poland are responsible for ensuring that their use of the services complies with local laws and regulations applicable in their jurisdiction.

17. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Poland.

Any disputes arising from or related to these Terms, the use of the platform, or purchases made through qPCR Academy shall be subject to the jurisdiction of the competent courts of Poland.

If you are a consumer residing in the European Union, nothing in these Terms limits any mandatory consumer protection rights granted to you under the laws of your country of residence.

18. Entire Agreement

These Terms & Conditions constitute the entire agreement between qPCR Academy and the user regarding the use of the platform and supersede any prior communications or understandings relating to the services provided.

19. Modifications to Terms

We may update these Terms at any time.

The most recent version will always be available on this page.

Continued use of the platform constitutes acceptance of updated Terms.
